NREW Terms & Conditions

These Terms & Conditions govern your use of the NREW website, NREW subscription and purchases of individual digital music tracks from NREW.
By using this website, purchasing a track or starting an NREW subscription, you agree to these Terms & Conditions and any licence terms that apply to music you download.
Nothing in these Terms & Conditions excludes, restricts or replaces any statutory rights or remedies available to you under applicable UK law.
1. About NREW
NREW provides original music for listening and discovery through NREW Radio and the NREW website.
NREW also offers a monthly subscription which allows active subscribers to download music from the NREW Track Catalogue, subject to the subscription terms, fair-use provisions and applicable download licence.
Individual tracks may also be available to purchase without a subscription.
Downloading or purchasing NREW music does not transfer ownership of the copyright, master recording, publishing rights or other intellectual-property rights in the music.
2. NREW Subscription
The NREW subscription is a recurring monthly subscription. The current subscription price and the features included are displayed on the subscription page before you subscribe.
Your subscription begins when your initial payment has been successfully processed and will renew automatically each month until cancelled.
An active subscription allows you to download tracks from the NREW Track Catalogue in accordance with the subscription conditions, fair-use provisions and the licence supplied with each download.
NREW may reasonably change the content of the Track Catalogue over time. The availability of a particular track is not guaranteed indefinitely.
3. Subscription Renewals
Your NREW subscription renews automatically each month using the payment method associated with your subscription unless you cancel before the next renewal is processed.
If a renewal payment is successful, your subscription will continue for the next monthly subscription period.
If a renewal payment fails, access to subscriber benefits may be restricted, suspended or ended in accordance with the subscription and payment arrangements applicable to your account.
NREW may change the subscription price in the future. Where a price change affects an existing subscriber, NREW will provide any notice required by applicable law before the new price takes effect.
4. Cancelling Your Subscription
You may cancel your monthly NREW subscription at any time.
Cancellation stops future subscription renewals. Unless otherwise stated or required by law, your subscription will remain active until the end of the subscription period you have already paid for.
You should cancel before your next renewal payment is processed if you do not want the subscription to continue for another month.
Cancellation does not normally result in a refund of a subscription payment that has already been correctly processed. Your statutory rights are unaffected.

5. Subscriber Downloads
Active subscribers may download music from the NREW Track Catalogue subject to the subscription conditions and applicable fair-use provisions.
Subscriber access is intended for the subscriber’s own use. You must not share your subscriber account or use it to obtain downloads for another person, business or account.
NREW may apply reasonable technical and fair-use controls to protect the service against automated downloading, account sharing, excessive downloading, redistribution or other misuse.
Each downloaded track remains subject to the Subscriber Download Licence or other licence supplied or made available with that download.
Ending your subscription does not transfer ownership or copyright in previously downloaded NREW music to you. Any continuing use of downloaded music remains subject to the licence under which it was supplied.
6. Individual Track Purchases
You do not need an NREW subscription to purchase an individual track where individual purchasing is offered.
When you place an order, you are purchasing the digital product identified on the relevant product or checkout page together with the right to use it in accordance with the licence terms applicable to that purchase.
The price payable is the price displayed at the time you place your order. Prices are shown in Pounds Sterling (£ GBP) unless otherwise stated.
NREW may change prices or product availability at any time. A price change will not affect an individual order that has already been accepted and paid for.
7. Orders and Payment
An individual track order is accepted when payment has been successfully processed and NREW provides confirmation of the order.
Subscription access begins when the applicable initial subscription payment has been successfully processed.
Payments are processed through the payment methods made available at checkout. Complete payment-card details are handled by the relevant payment provider rather than being stored by NREW.
NREW may refuse or cancel an order or subscription transaction where payment has not been authorised, where there is an obvious pricing or technical error, where fraud or misuse is reasonably suspected, or where completing the transaction would be unlawful.
Where payment has already been taken for a transaction that NREW subsequently cancels, any refund legally due will be made in accordance with the NREW Refund & Cancellation Policy and applicable law.
8. Digital Delivery
NREW music downloads are supplied electronically using the download method made available through the website, checkout, order confirmation, email or customer account, as applicable.
You are responsible for providing accurate account and contact information and for maintaining access to the account, email address and equipment used to access your purchase or subscription.
If a download is not made available because of a technical problem with NREW’s website or delivery system, please contact NREW so that the issue can be investigated and an appropriate remedy provided.
9. Digital Content and Cancellation Rights
NREW music downloads are digital content supplied without a tangible medium.
Where you ask NREW to make digital content available immediately before the end of an applicable statutory cancellation period, NREW may obtain your express consent to immediate supply and your acknowledgement that your statutory right to cancel will be lost once supply begins where required by law.
Where the consent and acknowledgement required by law have been properly obtained and supply has begun, you will no longer have the applicable statutory cancellation right for that digital content simply because you have changed your mind.
This does not affect your statutory rights where digital content is faulty, not as described, not of satisfactory quality or otherwise does not conform to the contract.

10. Music Licences
Your subscription or individual track purchase gives you permission to use downloaded NREW music only in accordance with the licence terms applicable to that download.
Downloading a track does not transfer copyright or ownership of the music to you and does not give you the right to sell, redistribute, sublicense, publicly distribute or claim ownership or authorship of the recording.
Where specific licence terms are displayed or supplied with a download, those terms form part of the agreement governing your permitted use of that music.
If there is a conflict between these Terms & Conditions and specific music licence terms, the specific licence terms take precedence in relation to the permitted use of the music.
11. Customer Accounts
Some NREW services require or allow you to create a customer account. Account facilities may allow you to manage your subscription, view orders, access available downloads, manage payment information and update account details.
Your account is personal to you. You must keep your login details confidential and must not share your account with another person or business.
You are responsible for activity carried out through your account where that activity results from your failure to keep your login information secure.
Please notify NREW promptly if you believe your account has been accessed without permission.
12. Product and Track Information
NREW takes reasonable care to ensure that track information, descriptions, artwork, listening facilities and prices are accurate.
Audio quality and playback may vary according to your device, software, speakers, headphones, internet connection or other equipment. Artwork may also appear differently depending on the device or display used.
13. Intellectual Property
Unless otherwise stated, NREW music, recordings, artwork, branding, logos, graphics, written material and website content are owned by NREW and/or the relevant rights holder and are protected by applicable intellectual-property law.
No ownership rights are transferred merely because you access the website, listen to NREW Radio, listen to music through the website, subscribe to NREW or purchase or download a track.
14. Acceptable Use
You must not:
- attempt to interfere with the security, operation or availability of the NREW website or services;
- attempt to gain unauthorised access to another person’s account or NREW systems;
- introduce malicious software, harmful code or automated systems intended to interfere with or misuse the service;
- share a subscriber account with another person or business;
- copy, share, resell, redistribute or sublicense downloaded NREW music except where expressly permitted by the applicable licence;
- make NREW music files available for public download;
- claim ownership, authorship or exclusive rights over NREW music;
- use NREW music to train artificial-intelligence or machine-learning systems;
- use NREW music in a competing music library, stock music service, subscription platform or resale catalogue;
- misrepresent yourself as NREW or falsely claim ownership of NREW content; or
- use the website, your account or NREW content for an unlawful purpose.

15. Suspension or Termination
NREW may suspend or terminate access to an account or service where there is a material breach of these Terms & Conditions, misuse of NREW music or services, fraudulent activity, unlawful activity, account sharing or another legitimate reason for doing so.
Where reasonably appropriate, NREW may provide an opportunity to resolve a problem before access is terminated. This does not prevent NREW from acting immediately where necessary to protect NREW, its systems, its rights, other users or third parties.
Any suspension or termination will not affect statutory rights that cannot lawfully be excluded.
16. NREW Radio and Free Listening
NREW may make music available for free listening and discovery through NREW Radio or other listening facilities.
Listening to NREW music does not constitute a purchase and does not grant a right to download, copy, redistribute or otherwise use the music except as expressly permitted by NREW.
NREW may change programmes, tracks, schedules, listening facilities or availability without notice.
17. Website and Service Availability
NREW aims to keep the website and its services available but does not guarantee uninterrupted or error-free access.
Maintenance, updates, security requirements, third-party services, internet failures or technical problems may occasionally affect availability.
18. Liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful or limits any statutory rights that cannot lawfully be excluded.
Subject to those rights and to the extent permitted by law, NREW is not responsible for losses that were not reasonably foreseeable when the relevant contract was formed or for losses caused by circumstances outside NREW’s reasonable control.
Where you purchase or use NREW in the course of a business, NREW will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business opportunity or business interruption except where liability cannot lawfully be excluded or limited.
19. Privacy
Personal information is handled in accordance with the NREW Privacy Policy. Please read that policy for information about how personal data is collected, used and protected.
20. External Services
The NREW website may use or link to third-party payment services, websites or other external services.
NREW is not responsible for the independent content or practices of third-party websites. Your use of a third-party service may also be subject to that provider’s own terms and privacy policy.
21. Changes to These Terms
NREW may update these Terms & Conditions from time to time to reflect changes to the website, subscription, products, services, business model or applicable requirements.
The terms applicable when you make an individual purchase will apply to that purchase unless a change is required by law or expressly agreed with you.
Where a change materially affects an existing subscription, NREW will provide any notice required by applicable law.
22. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer, nothing in these Terms deprives you of any mandatory protections or rights you have under applicable law. Any provision concerning jurisdiction applies only to the extent permitted by law.
