NREW Website Terms & Conditions

These Terms & Conditions govern your use of the NREW website and
purchases of digital music and other digital products from NREW. By
using this website or placing an order, you agree to these Terms &
Conditions.
1. About NREW

NREW provides original music for listening and discovery through NREW
Radio and makes selected music available to purchase as digital
downloads through this website.
Digital products are supplied electronically. Purchasing a music
download does not transfer ownership of the copyright, master recording,
publishing rights or other intellectual-property rights in the music.
2. Purchasing Digital Music

When you place an order, you are purchasing the digital product
identified on the relevant product or checkout page together with the
right to use it in accordance with the licence terms made available by
NREW for that product.
The price payable is the price displayed at the time you place your
order. Prices are shown in Pounds Sterling (£ GBP) unless otherwise
stated.
NREW may change prices or the availability of products at any time. A
price change will not affect an order that has already been accepted and
paid for.
3. Orders and Payment

An order is accepted when payment has been successfully processed and
NREW provides confirmation of the order.
Payments are processed through the payment methods made available at
checkout. Payment-card information is handled by the relevant payment
provider and is not stored by NREW as complete card details.
NREW may refuse or cancel an order where payment has not been
authorised, where there is an obvious pricing or technical error, where
fraud or misuse is reasonably suspected, or where completing the order
would be unlawful. Where payment has already been taken for an order
that NREW cancels, the amount paid for that cancelled order will be
refunded.
4. Digital Delivery

Purchased digital music is supplied electronically using the download
method shown during or after checkout. This may include access from the
order confirmation page, an order email or a customer account where that
facility is available.
You are responsible for providing an accurate email address and for
maintaining access to the device, account or email address used to
receive your purchase.
If a paid download is not made available because of a technical problem
with NREW’s website or delivery system, please contact NREW so that the
order can be investigated and, where appropriate, the download can be
supplied again or another appropriate remedy provided.
5. Digital Content and Cancellation Rights

Digital music downloads are digital content supplied without a tangible
medium.
Where you ask NREW to make a digital download available immediately,
before the end of any statutory cancellation period, NREW will obtain
any consent and acknowledgement required by applicable consumer law
before supply begins. Where the law provides that your cancellation
right is lost after supply begins following that consent and
acknowledgement, you will no longer have that cancellation right once
supply has begun.
This does not affect your statutory rights where digital content is
faulty, not as described, not of satisfactory quality or otherwise does
not conform to the contract.

6. Music Licence

Your purchase gives you permission to use the downloaded music only in
accordance with the NREW licence terms that apply to that purchase.
Unless NREW expressly states otherwise, purchasing or downloading a
track does not transfer copyright or ownership of the music to you and
does not give you the right to sell, redistribute, sublicense or claim
ownership of the recording.
Where separate licence terms are displayed or supplied with a purchase,
those licence terms form part of the contract and govern the permitted
use of the music. If there is a conflict between these Website Terms &
Conditions and specific music licence terms, the specific licence terms
take precedence in relation to use of the music.
7. Customer Accounts

Some NREW services may allow or require you to create a customer
account. Where account facilities are provided, they may allow you to
view orders, access available downloads and manage account information.
You are responsible for keeping your login details confidential and for
activity carried out through your account. Please notify NREW if you
believe your account has been accessed without permission.
8. Product Information

NREW takes reasonable care to ensure that track information,
descriptions, artwork, audio previews and prices are accurate.
Audio quality and playback may vary according to your device, software,
speakers, headphones, internet connection or other equipment. Artwork
may also appear differently depending on the device or display used.
9. Intellectual Property

Unless otherwise stated, NREW music, recordings, artwork, branding,
logos, graphics, written material and website content are owned by NREW
and/or the relevant rights holder and are protected by applicable
intellectual-property law.
No ownership rights are transferred merely because you access the
website, listen to NREW Radio, hear a preview or purchase a digital
download.
10. Acceptable Use

You must not:
attempt to interfere with the security, operation or availability of the
NREW website;
attempt to gain unauthorised access to another person’s account or NREW
systems;
introduce malicious software or harmful code;
copy, share, redistribute or make downloaded music available contrary to
the applicable licence;
misrepresent yourself as NREW or falsely claim ownership of NREW
content; or
use the website or NREW content for an unlawful purpose.
11. NREW Radio and Free Listening

NREW may make music available for free listening or discovery through
NREW Radio or other listening facilities. Listening to a stream or
preview does not constitute a purchase and does not grant any right to
download, copy, redistribute or commercially exploit the music.
NREW may change programmes, tracks, schedules, listening facilities or
availability without notice.
12. Website Availability

NREW aims to keep the website and its services available but does not
guarantee uninterrupted or error-free access. Maintenance, updates,
third-party services, internet failures or technical problems may
occasionally affect availability.
13. Liability

Nothing in these Terms & Conditions excludes or limits liability where
doing so would be unlawful, or limits any statutory rights that cannot
lawfully be excluded.
Subject to those rights and to the extent permitted by law, NREW is not
responsible for losses that were not reasonably foreseeable when the
contract was formed or for losses caused by circumstances outside NREW’s
reasonable control.
Where you purchase in the course of a business, NREW will not be liable
for indirect or consequential loss, loss of profit, loss of revenue,
loss of business opportunity or business interruption except where
liability cannot lawfully be excluded or limited.
14. Privacy

Personal information is handled in accordance with the NREW Privacy
Policy. Please read that policy for information about how personal data
is collected, used and protected.
15. External Services and Links

The NREW website may use or link to third-party websites, payment
services or other external services. NREW is not responsible for the
content or independent practices of third-party websites. Your use of a
third-party service may also be subject to that provider’s own terms and
privacy policy.
16. Changes to these Terms

NREW may update these Terms & Conditions from time to time to reflect
changes to the website, products, business model or applicable
requirements.
The version published when you place an order will apply to that order
unless a change is required by law or is expressly agreed with you.
17. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer, nothing in these Terms deprives you of any
mandatory protections or rights you have under applicable law. Any
provision concerning jurisdiction applies only to the extent permitted
by law.
