1. About These Terms
These Partner Programme Terms form an agreement between NREW and each person or business accepted into the NREW Partner Programme.
By applying to join, accessing the Partner Portal, generating a referral link or promoting NREW as an approved Partner, you agree to these Terms, the NREW Privacy Policy and any programme guidance provided through the Partner Portal or Partner Support Centre.
2. Eligibility and Approval
Participation is by application and is not automatic. NREW may approve, decline or request additional information about any application.
Applicants must provide accurate and current information. You must be at least 18 years old and legally able to enter into this agreement. Businesses must apply through a person authorised to act on their behalf.
Approval applies only to the person or business named in the application. Partner accounts may not be sold, transferred or shared without written permission from NREW.
3. Independent Relationship
Partners are independent contractors. Nothing in these Terms creates an employment relationship, agency, partnership, franchise, joint venture or authority to bind NREW.
You are responsible for your own working arrangements, expenses, equipment, insurance, tax returns and any tax, National Insurance, VAT or other liabilities arising from commission payments.
4. Referral Links and Tracking
Approved Partners receive access to tracked referral links through the Partner Portal. AffiliateWP and related website technology are used to record eligible visits, purchases and commissions.
A referral will normally be attributed according to the tracking settings currently used by the programme, including the referral-link format, attribution method and cookie duration displayed in AffiliateWP or communicated by NREW.
Tracking can be affected by browser settings, cookie choices, privacy software, device changes, incorrect links and other technical factors. NREW cannot guarantee that every visit or introduction will be tracked.
AffiliateWP and WooCommerce records will normally be used to determine whether a referral qualifies. NREW may investigate and correct clear errors where reasonable evidence is available.
5. Qualifying Referrals
A qualifying referral is a genuine customer purchase that:
- originates through an approved Partner referral link or other recognised tracking method;
- is successfully paid for through the NREW website;
- is not cancelled, refunded, reversed, disputed or identified as fraudulent;
- complies with these Terms and the rules of the Partner Programme; and
- has completed any validation or holding period applied by NREW.
NREW may reject, reverse or withhold commission for duplicate orders, test orders, artificial transactions, misuse of discount codes, payment disputes or activity intended to manipulate the programme.
6. Self-Referrals
Partners must not use their own referral link to earn commission on their own purchases, purchases made on their behalf, or purchases made by a business they own or control unless NREW has given prior written permission.
7. Commission
The applicable commission rate, calculation method and any product-specific arrangements are those shown in the Partner Portal or current Partner Programme information.
Commission is calculated on the eligible order value determined by NREW. Unless expressly stated otherwise, commission does not apply to refunded amounts, taxes, payment charges, delivery charges, credits, chargebacks or other excluded amounts.
NREW may introduce or amend commission rates, promotional rates or product exclusions. Changes will normally apply prospectively and will be communicated through the website, Partner Portal or email.
8. Payments and Stripe
Partners must maintain an eligible Stripe account and provide accurate payment information. NREW does not offer alternative payment methods unless it expressly agrees otherwise in writing.
Approved commissions are paid according to the payment schedule, validation process and any minimum threshold communicated through the Partner Portal or programme information.
NREW is not responsible for payment delays caused by incorrect account details, Stripe restrictions, identity-verification requirements, sanctions screening, banking delays or circumstances outside NREW’s reasonable control.
Where a payment fails, the amount may remain pending until valid payment information is provided. NREW may request identity, tax or business information where reasonably necessary to administer payments or comply with legal obligations.
9. Refunds, Chargebacks and Reversals
If a referred order is refunded, cancelled, disputed, reversed or charged back, the related commission may be rejected, cancelled or deducted from a future Partner payment.
If commission has already been paid, NREW may offset the corresponding amount against future commission or request repayment where appropriate.
10. Advertising Disclosure
Partners must make the commercial nature of their relationship with NREW clear wherever a referral link, recommendation or promotional communication may earn commission.
Disclosures must be prominent, easy to understand and placed where people will see them before or when they engage with the promotional content. Depending on the context, appropriate wording may include “Ad”, “Advertisement”, “Affiliate link” or “I may earn commission from purchases made through this link”.
Partners are responsible for following applicable advertising laws, the CAP Code, platform rules and any NREW disclosure guidance.
11. Marketing Standards
Partners must promote NREW honestly, professionally and accurately. Marketing must not be misleading, aggressive, discriminatory, unlawful or damaging to the NREW brand.
Partners must not:
- make guaranteed, medical, therapeutic, financial or other unsupported claims;
- misrepresent NREW products, prices, licences, availability or business arrangements;
- claim to be employed by, formally representing or authorised to contract on behalf of NREW;
- use false scarcity, fabricated reviews, misleading comparisons or invented customer results;
- send unlawful spam or unsolicited marketing;
- publish offensive, defamatory or unlawful content in connection with NREW;
- use NREW to promote illegal goods, adult content, hate, harassment or deceptive schemes;
- bid on NREW brand terms in paid search advertising without written approval;
- register domains, social accounts or business names that impersonate NREW; or
- place referral links on coupon, cashback or incentive websites without written approval.
12. Email and Direct Marketing
Partners must comply with applicable privacy and electronic-marketing rules when contacting businesses or individuals. This includes respecting consent requirements, opt-outs and lawful-basis obligations where personal information is used.
You must not provide customer or prospect personal information to NREW unless there is a lawful reason to do so and the person has received any required privacy information.
13. NREW Branding and Creative Materials
NREW grants approved Partners a limited, non-exclusive, revocable and non-transferable permission to use the logos, images, captions, links and other materials made available through the Partner Programme solely to promote NREW in accordance with these Terms.
Partners must not materially alter NREW logos, remove copyright or ownership notices, create confusingly similar branding, imply sponsorship that does not exist or use outdated creatives after NREW asks that they be withdrawn.
All rights in NREW branding, website content, product artwork, audio, written materials and programme resources remain with NREW or the relevant rights owner.
14. Product and Licence Information
Partners must describe NREW products and licences accurately. Business customers generally require one licence for each business location unless the applicable product page or licence states otherwise. Personal and home-use permissions are governed by the licence supplied with the relevant purchase.
Partners must not provide legal interpretations of the NREW Music Licence or promise permissions beyond those stated by NREW. Questions should be directed to NREW support.
15. Customer Relationships
Customers introduced through the Partner Programme purchase directly from NREW. NREW is responsible for the sale, fulfilment, licence, refunds and customer support relating to purchases made through the NREW website.
Partners must not collect payment on behalf of NREW, issue NREW invoices, agree discounts or vary NREW terms without prior written authority.
16. Account Security
You are responsible for keeping your login details secure and for activity carried out through your Partner account. You must notify NREW promptly if you suspect unauthorised access, lost credentials or misuse of your referral links.
17. Monitoring and Information Requests
NREW may review Partner websites, social posts, advertisements, referral activity and use of NREW materials to protect customers and the programme.
Partners must provide reasonable information requested to investigate suspicious referrals, complaints, advertising compliance or payment issues.
18. Suspension and Termination
Either party may end participation in the programme at any time by giving notice.
NREW may suspend or terminate a Partner account immediately where it reasonably believes there has been fraud, misleading promotion, misuse of branding, unlawful activity, non-disclosure of affiliate advertising, manipulation of tracking, breach of these Terms or conduct likely to damage customers or NREW.
Following termination, the Partner must stop presenting themselves as an NREW Partner, stop using programme materials and remove active promotional content when requested.
Valid approved commission earned before termination may remain payable. NREW may reject unpaid commission connected with a breach, fraud, invalid referrals or unlawful activity.
19. Programme Availability and Changes
NREW may modify, pause or discontinue the Partner Programme, its technology, features, creative materials, commission structure or eligibility rules.
Reasonable notice will be given for material changes where practicable. Continued participation after changes take effect constitutes acceptance of the revised Terms.
20. Technology and Availability
NREW aims to keep the website, Partner Portal and tracking systems available, but uninterrupted or error-free operation is not guaranteed. Maintenance, updates, third-party services, internet failures and security incidents may affect availability or tracking.
21. Liability
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to that, NREW will not be liable for indirect or consequential loss, loss of anticipated profit, loss of opportunity, loss caused by tracking failures or losses arising from a Partner’s own marketing, tax, legal or business decisions.
NREW’s total liability arising from the Partner Programme will, to the extent permitted by law, be limited to the unpaid valid commission due to the Partner during the 12 months preceding the event giving rise to the claim.
22. Indemnity
You are responsible for claims, losses or costs reasonably incurred by NREW as a direct result of your unlawful marketing, infringement of third-party rights, misuse of personal information, unauthorised claims or material breach of these Terms.
23. Data Protection
NREW processes Partner information for application review, account administration, fraud prevention, communication, referral tracking and payments in accordance with its Privacy Policy.
Where a Partner independently collects or uses personal information for marketing, the Partner is responsible for complying with applicable data-protection and electronic-marketing requirements.
24. Confidential Information
Partners must not disclose non-public information identified as confidential or that would reasonably be understood to be confidential, including unreleased products, private commission arrangements, security information and internal programme communications.
25. Notices and Contact
Programme notices may be delivered by email, through the Partner Portal or by publication on the NREW website. Partners must keep their contact information current.
Questions about these Terms should be sent to support@nrew-radio.com.
26. General Provisions
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
A delay in enforcing a right does not waive that right. A Partner may not assign this agreement without NREW’s written consent.
These Terms, together with the current programme information and policies referred to in them, form the agreement governing participation in the NREW Partner Programme.
27. Governing Law
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction over disputes arising from the Partner Programme, subject to any rights that cannot lawfully be excluded.
28. Acceptance
By applying to the NREW Partner Programme and continuing to participate after approval, you confirm that you have read, understood and agreed to these Terms.
